Mexico – Mexican Official Standard PROY-NOM-199-SCFI-2015 for Alcoholic beverages

Ministry of the Economy has issued notified draft Mexican Official Standard applies to all alcoholic beverages marketed in national territory, whether produced and packaged in Mexico or imported into the country. The designations of these products must comply with the applicable provisions and specifications established in this draft Standard.

The notified draft Standard defines the designations used for different types of alcoholic beverages and establishes physicochemical specifications, commercial information requirements, and the test methods that must be applied to determine compliance with the aforementioned specifications. It seeks to curtail the deceptive marketing of the products concerned, to the benefit of Mexican consumers. The draft Standard also seeks to help consumers avoid wasting money, in accordance with Article 32 of the Mexican Federal Consumer Protection Law and Article 18 of its Implementing Regulations, and to eliminate confusion by providing consumers with accurate and verifiable information regarding the products they buy.

Article 32 of the Mexican Federal Consumer Protection Law establishes that information or advertising concerning goods, products or services, that is disseminated via any medium or in any form, shall be accurate and verifiable and not contain any text, dialogue, sounds, images, trademarks, designations of origin or other descriptions that mislead or are likely to mislead or cause confusion due to their deceptive or unscrupulous nature.

Furthermore, in accordance with Article 1, paragraph III, of the Mexican Federal Consumer Protection Law, the issuing of the draft Mexican Official Standard for alcoholic beverages protects consumers by ensuring that they receive adequate and clear information on the products they buy.
