Dear Madam/Sir,
  1. As per Public Notice 10/2015-2020 dated 22 May, 2018 (Click Here) issued by the DGFT export obligation under EPCG scheme has been made more flexible as non-maintenance of Annual Average in some years can be offset by excess exports in other year(s) in respect of EPCG authorisations.

  2. As per Trade Notice 11/2018-19 dated 18 May, 2018 (Click Here) issued by the DGFT date for mandatory digital payment through e-MPS is extended to 01.06.2018.

  3. The DGFT has published Trade Notice 12/2018-19 dated 18 May, 2018 (Click Here) regarding clarification on Irrevocable Commercial Letter of Credit (ICLC) and Advance Payment made through banking channel on import of Peas under Chapter 7 of the ITC (HS) 2017 before 25 April, 2018.

  4. The DGFT has published Trade Notice 13/2018-19 dated 22 May, 2018 (Click Here) issued by the DGFT related to quota under Indo-Sri Lanka Free Trade Agreement.

  5. As per Circular 06/2018 dated 22 May, 2018 (Click Here) issued by the DGFT the actual Service Providers (and not Ports) are eligible for SFIS/SEIS benefit in respect of their share of earnings made by performing the notified services under SFIS/SEIS Scheme.

  6. The DGFT has clarified that the term "Duty" used in respect of the items listed in Appendix 3A is to be read as "Basic Customs duties" only and not "all Customs duties (including BCD=SAD/IGST)" as per the Circular 07/2015-20 dated 23 May, 2018 (Click Here).

  7. Central Board of Indirect Taxes And Customs (CBIC), Department Of Revenue, Ministry of Finance, India published following:

As per RBI circular, an exporter gets caution listing for three months and directed banks to close entries in Export Data Processing and Monitoring System (EDPMS) where export revenue was received. Due to human resource and technical constraints, banks could not complete it prompting exporters to approach RBI and commerce ministry again seeking extension of exemption from caution listing. The same was granted by RBI for six months and later it got extended by 30 September, 2018 (Click Here).

  12. The Department of Agriculture and Water Resources (DAWR), Australia published IFN 03-18 – Country of Origin Labelling dated 14 May, 2018 (Click Here). The purpose of this notice is to advise food importers that the new requirements for declaring the country of origin on food labelling will be verified during border inspections from 1 July, 2018.

  20. The USDA Food Safety and Inspection Service published dated 17 May, 2018 notice to provide instructions to inspection program personnel (IPP) regarding the acquisition and use of the following new and updated export forms (Click Here):

    • FSIS Form 9060-6, Application for Export Certificate,

    • FSIS Form 9060-5, Meat and Poultry Export Certificate of Wholesomeness,

    • FSIS Form 9060-5S, Siluriformes Fish and Fish Products Export Certificate of Wholesomeness,

    • FSIS Form 9060-5A, Meat, Poultry, and Egg Product Certificate of Wholesomeness,

  21. The U.S. Food and Drug Administration is extending the compliance date for certain uses of partially hydrogenated oils (PHOs) (Click Here). For the majority of uses of PHOs, 18 June 2018 remains the date after which manufacturers cannot add PHOs to foods. However, to allow for an orderly transition in the marketplace, the FDA is allowing more time for products produced prior to 18 June, 2018 to work their way through distribution. The FDA is extending the compliance date for these foods to 1 January, 2020.
