France proposed decree on the limitation of the capacity of civil aircraft traveling without a person on board Directorate of Civil Aviation Safety proposed text aims to supplement the French regulatory framework for aircraft traveling without a person on board, for reasons of public security and State security, constituted by the Decree of 17 December 2015 on the design of civil aircraft operating without any person on board, the conditions of their use and the capabilities required of the persons using them, and the Decree of 17 December 2015 as amended on 30 March 2017 relating to the use of airspace by aircraft traveling without a person on board. The technical requirements contained in this draft decree aim to ensure that UAVs ultimately embark on a capacity limitation device, preventing them from reaching a maximum flight height, in order to avoid, on the one hand, the spreading of drones and, in particular, intentional divagation of recreational drones in the spaces frequented by manned aircraft and the approach of sensitive sites by drones flying in a furtive way, because at high heights, these behaviors are likely to constitute an attack on the safety of the State. However, drones registered before 1 July 2018 pursuant to Article L. 6111-1 of the Transport Code will be able to be equipped as of 1 January 2019 with a function alerting the remote pilot to the approach of a maximum flight height.
