Thailand proposed Notifications on infant food

Ministry of Public Health proposed following:

A) Ministerial notification on the guidance, methods, conditions, and details regarding the development of information and dissemination channels of information:

The Control of Marketing of Infant and Young Child Food Act Section 4 (first paragraph), Section 16 (second and third paragraph), the Minister of Public Health, upon the advice of the National Committee for the Control of the Marketing of Infant and Young Child Food, announces the guidance, methods, conditions, and details regarding the development of information and dissemination channels of information on infant food. 

1)         In developing information on infant food, the producers, importers, sellers, or their representatives, must include the following information:

  • Number of unit (can/box) of infant food needed per month, in case that infant is exclusively formula-fed. The calculation should based on the average amount of infant formula needed for infant 0-3 months (2.7 kg of infant formula) and for infant 4-6 months (4.5 kg of infant formula)
  • Estimate monthly cost of infant food needed per month, based on the number of unit needed x the retail price

The example of statement is given.

2)         The producers, importers, sellers, or their representatives, must include the warning regarding the preparation and use of infant food, including:

  • Storing the infant food
  • Cleaning of bottles and teats
  • Boiling water for mixing the infant formula
  • Discarding leftover infant formula

3)         Information about infant food that are produced by producers, importers, sellers, or their representatives can only be disseminated as document at the point of sale only

4)         In case pregnant women, mothers, family members of infant and young children request for information to the producers, importers, sellers, or their representatives, the following guideline must be applied:

  • Only present the information requested to the requester
  • Do not use any incentive in the attempt to get them to contact the producers, importers, sellers, or representative, to receive information or in exchange for their personal information

Do not market, promote, or imply connections to infant food when providing information

B) Ministerial notification on the scientific evidence to support the information on infant food, young child food, and complementary food:

The Control of Marketing of Infant and Young Child Food Act Section 4 (first paragraph), Section 17, and Section 29, the Minister of Public Health, upon the advice of the National Committee for the Control of the Marketing of Infant and Young Child Food, announces the scientific evidence to support the information on infant food, young child food, and complementary food. 

In summary:

1)         In providing information on infant food, young child food, and complementary food to health professionals, the producers, importers, sellers, or their representatives, must have the scientific evidence to support, which must come from one of the following sources:

  • Published article in related academic journals that are widely accepted.
  • Trusted database of scientific peer review journals
  • Report of expert committee

2)      Inreferencing the scientific evidence, the producers, importers, sellers, or their representatives, must present the information to the health professionals as document or electronic document which include the published article that are referenced.

C) Ministerial notification on guideline, methods, and conditions of customary giving to health professionals:

The Control of Marketing of Infant and Young Child Food Act Section 4 (first paragraph), Section 20 (second paragraph), and Section 29, the Minister of Public Health, upon the advice of the National Committee for the Control of the Marketing of Infant and Young Child Food, announces Guideline, methods, and conditions of customary giving to health professionals. 

In summary:

The producers, importers, sellers, or their representatives, are prohibited to give or offer to give gifts, money, incentives, or any other benefits to the health professionals, except in the case of customary giving which must follow the following conditions:

  • value in each occasion is no more than 3,000 Thai baht
  • must be similar to practices done to regular people.
  • must not have any condition of exchange in favour
  • gifts, money, incentives, or any other benefits must not have the name, logo, symbols that refers to the infant food, young child food, and complementary food

D) Ministerial notification on the rules, methods and conditions in sponsoring the public health professional organizations and public universities that offer curriculums on maternal and child health, in organizing academic conference, training or seminars in association with infant food, young child food or complementary food:

The Control of Marketing of Infant and Young Child Food Act Section 4 (first paragraph), Section 21, and Section 29 of the BMS Code Act, the Minister of Public Health, upon the advice of the National Committee for the Control of the Marketing of Infant and Young Child Food, announces the Guidance, methods and conditions in sponsoring the public health professional organizations and public universities that offer curriculums on maternal and child health, in organizing academic conference, training or seminars in association with infant food, young child food or complementary food.

In summary:

1)         The producers, importers, sellers, or their representatives (the sponsor) could provide financial support for the meeting following this notification in the case that the public health professional organizations or public universities that offer curriculums on maternal and child health submit the work plan or project proposal in official written form to the sponsor. The plan or project must provide academic benefit;

2)         The sponsoring of the meeting must be gratis with no conditions whatsoever that require any action in return to promote infant food, young child, or complimentary food for infant;

3)         The sponsor must submit a report regarding the sponsorship on meeting, training or seminar to the National Committee on the Control of the Marketing of Infant and Young Child Food on annual basis.

E) Ministerial notification on guideline, methods, and conditions of donation of infant food or young child food to health care institutions or health personnel:

The Control of Marketing of Infant and Young Child Food Act Section 4 (first paragraph), and Section 23 (second and third paragraph 29, the Minister of Public Health, upon the advice of the National Committee for the Control of the Marketing of Infant and Young Child Food, announces Guideline, methods, and conditions of donation of infant food or young child food to health care institutions or health personnel.

In summary:

1)         "Donor" refers to the producers, importers, sellers, or their representatives, who wish to donate infant food or young child food

2)         "Infant food or young child food with special purpose" refers to infant food or young child food that are specifically used for those with inborn errors of metabolism

3)            Infant food or young child food with special purpose can be donated to health care institutions that have infants or young children that have been diagnosed with inborn errors of metabolism in their care

4)            Infant food or young child food can be donated as necessary to

  • non-profit organizations that works on mother and child health and provide care for orphans, abandoned children, and infants whose mother are diagnosed with conditions that cannot breastfeed.
  • Health care institutions in areas that are declared as affected by emergencies

5)            The donors must submit report of their donation to the National Committee for Control of Marketing of Infant and Young Child food.
